Injunction application filed by Akosua Serwaa Fosua who claimed to be Daddy Lumba’s legal wife to stop the funeral of the highlife legend has been dismissed by the Kumasi Appeal Court.
The court presided over by Judge Dorinda Smith Arthur held that Daddy Lumba’s family are responsible to manage the corpse of their deceased under Ghana’s customary law.
Addressing the public after the court proceedings, Legal representative of the late Daddy Lumba’s family welcomed the court ruling described as good news.
According to him, there is currently no injunction on the body of Daddy Lumba and that the family has absolute right to make any determinations as to the type of burial and the role they will assign to any persons.
“Today, the court had to make a determination of the injunction application that has been placed on the body of our beloved Daddy Lumba. We made our superior submissions in court together with the counsel of the second defendant and the court heard our prayer and currently denied any injunction on the corpse.” The Lawyer stated.
“So currently, as we stand here, there is absolutely no injunction on the body of Daddy Lumba. The family has absolutely the right to make any determination as to the type of burial, the role they assign to any person, so that is the good news we have today.” He added.
Akosua Serwaa filed the injunction application to halt the funeral preparation of the late Ghana’s musician.
The woman argued that she is still the spouse of the late Daddy Lumba and for that matter she should be recognised as the widow during the funeral.
