Police, Attorney General sued over Akufo-Addo’s Deputy IGP appointment

A private legal practitioner, Justice Abdulai has sued the Attorney General (AG) and the Ghana Police Service (GPS) over the appointment of Commissioner of Police (COP) Mr. Christian Tetteh Yohuno as Deputy Inspector General of Police (IGP).

He said the creation of the office of Deputy Inspector-General of Police In Charge of Operations by the President of the Republic is unconstitutional, null and void.

This was contained in a writ dated July 30, 2024.

His argument comes after President Nana Addo Dankwa Akufo-Addo appointed Commissioner of Police (COP) Christian Tetteh Yohuno as the Deputy IGP in charge of operations.

Below is the writ:

IN THE NAME OF THE REPUBLIC OF GHANA, you are hereby commanded that within fourteen (14) days after service on you of the Plaintiff’s statement of case inclusive of the day of service, that you are to file or cause to file be filed for you a statement of the Defendant’s case in an action of the suit of:

JUSTICE ABDULAI

The nature of the relief’s sought by Plaintiff are as follows:

1 A declaration that on a true and proper interpretation of Articles 202(1), 202(2) 202(3) of the 1992 Constitution; Section 3 of the Police Service Act, 1970 (ACT 350) and Regulations 2, 6(1), 6(2), 6(3) and 6(4) of the Police Service Regulations 2012 (C.L 76), the creation of the office of Deputy Inspector-General of Police In Charge of Operations by the President of the Republic is unconstitutional, null and void.

2 A further declaration that on a true and proper interpretation of Articles 202(1), 202(2) 202(3) of the 1992 Constitution; Section 3 of the Police Service Act, 1970 (ACT 350) and Regulations 2, 6(1), 6(2), 6(3) and 6(4) of the Police Service Regulations 2012 (C.L 76), the appointment of Commissioner of Police (COP) Mr. Christian Tetteh Yohuno as Deputy Inspector-General of Police In Charge of Operations by the President of the Republic is unconstitutional, null and void.

3. An order restraining the Commissioner of Police (COP) Mr. Christian Tetteh Yohuno from acting or purporting to act as Deputy Inspector-General of Police In Charge of Operations.

4. A further order restraining the Inspector General of Police or any command under him from accepting, relating to and/or issuing instructions or commands to COP Mr. Christian Tetteh Yohuno in his assumed capacity as Deputy Inspector-General of Police In Charge of Operations.

Any further relief(s) order(s) or direction(s) as this Honourable Court may deem just and proper.

The capacity in which the Plaintiff brings action is as follows:

The Plaintiff brings this action as a citizen of the Republic of Ghana pursuant to Article 2(1) of the 1992 Constitution of the Republic of Ghana.
