Private Legal practitioner, Lawyer Gyebo has advised Ghanaians whose rights as a patient have been breached not to hesitate to seek legal advice.
He said the issue of medical negligence has become common in Ghana leading to loss of lives, worsened medical condition, emotional distress, financial losses.
Speaking in a video shared by Edhub on Twitter, Lawyer Gyebo advised Ghanaians who have gone through such experiences to test the law.
He said such people could be lucky to win damages to compensate for their loss.
“Ladies and gentlemen, the issue of medical negligence as I keep saying in Ghana, if your right as a patient is breached, you are highly advised not to keep silent but must explore and test our law. You never know you could be the next lucky one to win damages to compensate for your lost” He advised.
The Lawyer’s advice came after a Ghanaian woman, Mabel Mensah has reportedly won an amount of GHS 4.3 million against the Juaben Government Hospital for medical negligence.
Reports say the nurses administered the wrong prescription when she was admitted at the hospital for delivery.
The medical negligence affected the unborn baby which eventually led to Cerebral palsy.
Lawyer Gyebo said Mabel Mensah took the matter to Kumasi High Court and she won GHS 4.3 million against the Juaben Government Hospital.
The Legal Practitioner stated that if victims of medical negligence take bold decisions and report the matter to the court, Nurses will ensure professionalism in health care delivery to reduce the menace of medical negligence.
Adding that many people have kept silent which is not helping.
Medical negligence means failure to act in accordance with the standards of reasonably competent medical men at the time.
The patient must have suffered harm, injury, or damage as a direct result of the healthcare professional’s breach of the duty of care. This can include physical injuries, worsened medical condition, emotional distress, financial losses, or other adverse consequences.
