Daddy Lumba did not marry Odo Broni – Elder sister tells court

An elder sister of highlife musician Charles Kwadwo Fosuh, known in showbiz as Daddy Lumba, has told a Kumasi High Court that although she was aware of a long-term relationship between her late brother and Priscilla Ofori, popularly known as Odo Broni, the two were never married.

Ernestina Fosuh, also known as Akosua Brempomaah, testified that although the relationship produced six children, including a third child named after her, there was no marriage between them.

The legitimacy of an alleged marriage between Daddy Lumba and Priscilla Ofori is being contested by Akosua Serwaa Fosuh, who claims to be the legal wife of the late musician.

Madam Serwaa is asking the court to declare her the only surviving spouse and the one entitled to perform widowhood rites. She also wants an order restraining Priscilla Ofori from presenting herself as the musician’s wife.

Testifying under oath before Her Ladyship Dorinda Smith-Arthur, Ernestina Fosuh said her brother confided in her about “almost everything,” including his relationship with Odo Broni. She said the musician had relocated to Ghana to work on a housing project and seek treatment for a back injury sustained in a lorry accident.

When asked why Akosua Serwaa did not join her husband in Ghana, she told the court her brother advised his wife not to travel frequently because of high airfares and a €50,000 loan he allegedly took from a financial institution in Germany.

Defence lawyer Dominic Kwadwo Osei challenged this claim, insisting no such loan existed, which is why the witness could not provide proof. Ernestina maintained that the evidence, “written in Dutch,” was on her phone and that she was only repeating what her brother told her.

Counsel further pointed out that in the Plaintiff’s reply to the 2nd Defendant on 29 October 2025, the loan amount stated was €100,000, not €50,000, suggesting Ernestina’s account was misleading. She insisted she had told the court what she knew.

On who cared for the musician when he was unwell, Brempomaah told the court it was Odo Broni who stayed with him, while she (Brempomaah) provided whatever they needed.

According to her, the late Charles Kwadwo Fosuh married Akosua Serwaa in customary and civil ceremonies in Bomso and Germany in 1991 and 2004, respectively, ceremonies she personally witnessed.

She confirmed she knew her brother had six children with Priscilla Ofori, including a third-born named after her, adding that her brother named all his third-borns after her.

Although she never informed Akosua Serwaa about the children, she said Serwaa eventually found out through her own children, who regularly visited Daddy Lumba during vacation periods.

The proceedings took a dramatic turn when defence counsel asked whether she had ever acknowledged Odo Broni as a sister-in-law. Lawyer Dominic Kwadwo Osei tendered a video in which Priscilla Ofori wished Brempomaah a happy birthday on DL FM as her “sister-in-law.” An audio recording, which Brempomaah admitted “looks like” her voice, also captured her addressing Odo Broni as her “Akumaa,” meaning sister-in-law.

The evidence was admitted after no objections from the Plaintiff’s counsel.

Ernestina rejected suggestions by defence counsel that another woman, Theresah Abrebrese, performed the required in-law rites when her mother died. She insisted it was Akosua Serwaa who performed the “Nseyie,” explaining that Theresah only supported the family because of a longstanding relationship.

She also recounted how the late musician attended the funeral of Akosua Serwaa’s mother “in his black top and black down cloth.”

Responding to a question on whether she had cordial relations with the second defendant in the four months leading to Daddy Lumba’s death, she said she had never had any issues with Odo Broni.

Before the court adjourned, counsel for Odo Broni, Akwasi Nyarko, challenged her account of where the musician received medical treatment, noting that he underwent surgery in 2013 at FOCOS in Pantang and not Tantra Hills, as she had claimed. Brempomaah said she visited her brother at a hospital in Tantra Hills after returning from Germany.

Hearing continues on Wednesday, with Ernestina Fosuh expected to retake the witness stand.
