The Speaker of Parliament, Alban Sumana Bagbin has rejected a court document served by three (3) bailiffs.
The writ which was left at the Legal Service Office of the Parliamentary Service on Wednesday, 16th October 2024 with regards to four (4) Parliamentary Seats declared vacant by the Speaker.
The Speaker noted that the attempted services are contrary to Article 117 of the 1992 Constitution.
“I am directed by Rt. Hon. Alban Sumana Kingsford Bagbin, Speaker of Parliament to return the attached processes which were left at the Legal Service Office of the Parliamentary Service, by three (3) bailiffs of the court on Wednesday, 16th October 2024. Attempts were made to serve the same processes on Tuesday, 15th October, 2024.” Hon. Alban Bagbin said in a statement signed by the Deputy Clerk of Parliament, Ebenezer Djietror,
“The Rt. Hon. Speaker notes that the attempted services is contrary to Article 117 of the 1992 Constitution and the circular issued by her Ladyship, Justice Cyra Pamela C.A Korangteng (JA), the Judicial Secretary and copied to Honourable Lady Chief Justice, with reference number SCR9, entitled “Enforcement of article 117 and 118 of the constitution – immunity from service of process and arrest” dated 12th July 2024 addressed to all registrars of courts.” Part of the statement read.
“Consequently, the Rt. Hon. Speaker has directed the return of the attached processes for your necessary action.” It added.
It would be recalled that the Supreme Court issued a stay of execution on Speaker Alban Bagbin’s ruling, which declared four parliamentary seats vacant after the MPs declared their intentions to contest as Independent Candidates in the 2024 elections.
